Crack the TCF Canada – Terms of Service (ToS)

Welcome to Crack the TCF Canada (“we,” “our,” “us”). By enrolling in our courses, accessing our website (www.crackthetcfcanada.com), or making any payment to us, you (“student,” “client,” “you”) agree to be bound by these Terms of Service and related policies.

1. Services Provided

We offer two online categories of French language training services:

  • Online Instructor-Led Courses – fixed-period instructor-led lessons delivered virtually (four-week blocks).

  •
Self-Paced Recorded Courses – subscription-based digital learning content accessible through our online platform.

2. Refund & Cancellation Policy

Online Instructor-Led Classes:

  • Payment secures a student’s place in a scheduled class period.

  • If a student reserves a class spot but cancels 7 business days or more before the start date, a refund will be issued less a $50 administrative fee.

  • If cancellation is made fewer than 7 business days before the start date, no refund will be granted, except in cases of verified extenuating circumstances (e.g., medical emergencies). Proof may be required, and refunds and refund amount in such cases are at our sole discretion.

  • Once a period begins, fees are non-refundable.

Self-Paced Recorded Classes (Subscriptions):

  • Subscriptions are billed monthly.

  • All payments are non-refundable once charged.

  • Students must cancel their subscription at least 5 business days before their next billing date to avoid renewal. Students may do this by emailing the admin team at admin@crackthetcfcanada.com or cancelling their subscription through the online platform.

  • No refunds or credits will be issued for partial months, unused time, or failure to access content.

3. Charge-backs & Payment Disputes

  • By enrolling, you acknowledge that all charges are legitimate and authorized.

  • Any attempt to dispute charges via charge-back will be contested by us, and we reserve the right to provide proof of agreed Terms to payment processors and banks.

  • Students and payers remain jointly liable for any unpaid balances, charge-back fees, and collection costs.

4. Third-Party Payments

  • If payment is made by a spouse, parent, employer, or any third party, such payment constitutes authorization of enrolment.

  • Both the student and payer are jointly responsible for all charges, compliance with these Terms, and adherence to policies.

5. Age & Parental Consent

  • Our services are intended for individuals 18 years or older.

  • Students under 18 may enrol only with the consent of a parent or legal guardian, who then assumes full responsibility for compliance and payments.

6. Student Responsibilities

  • Students are responsible for:

    • Attending classes and keeping track of schedules.

    • Ensuring they have reliable internet access and functioning devices.

    • Completing assigned coursework within provided timelines.

  • Missed classes, technical failures on the student’s side, or lack of progress do not entitle students to refunds or credits.

7. Service Modifications

  • We reserve the right to update course content, reassign instructors, or adjust schedules with reasonable notice.

  • Such changes do not constitute grounds for refunds.

8. No Guarantee of Results

  • While we provide training and resources to prepare students for TCF/TEF exams, we do not guarantee exam results, immigration outcomes, or any specific performance levels.

9. Privacy & Data Protection

  • We collect names, emails, and payment information necessary for service delivery.

  • Credit card payments are securely processed through Stripe; we do not store card details.

  • We may use third party services for enrolment, communications, analytics, and advertising.

  • Data is used only for service delivery and business operations.

  • By enrolling, you consent to this data use.

  • We take reasonable measures to protect your personal data but cannot guarantee absolute security.

  • Data is retained only as long as necessary for legal, tax, or service purposes. Students may request deletion, subject to legal retention requirements.

10. Limitation of Liability

  • To the fullest extent permitted by Canadian law, our liability for any claim arising out of services is limited to the amount paid by the student for the relevant service period.

  • We are not liable for indirect, incidental, or consequential damages, including but not limited to: loss of opportunity, exam failure, missed deadlines, or platform outages.

11. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada. Any disputes shall be resolved exclusively in the courts of British Columbia.

12. Acceptance of Terms

  • By enrolling in our services, submitting payment (via e-transfer, credit card, Stripe, or other methods), or participating in our classes, you confirm that you have read, understood, and agree to these Terms of Service.
